The Patents Committee Meeting at the Asian Patent Attorneys Association (APAA) Convention provided a valuable platform for member countries to share the latest developments in their patent systems. Keynote speakers from each jurisdiction presented updates on statistics, legislative reforms, and landmark decisions, highlighting the dynamic evolution of patent laws in Asia.These insights provided a comprehensive overview of the dynamic intellectual property environment across Asia, fostering dialogue and collaboration among APAA members.

Myanmar’s report garnered significant attention, as it marked a historic milestone when it officially launched its patent filing system just this November 2024. Implemented under the Patent Law 2019, the system aligns Myanmar with international standards such as the Paris Convention and the WTO. The initial steps include the issuance of forms and procedures for patent and utility model applications, with publications set for 18 months post-filing unless early publication is requested. The Myanmar delegation emphasized the importance of capacity building and raising public awareness to ensure the system’s success, while also addressing initial challenges in implementation.

Singapore’s update showcased advancements in the city-state’s already sophisticated patent framework. Among the highlights was the decision in Millennium Pharmaceuticals Inc. and Johnson & Johnson Pte Ltd v. Zyfas Medical Co [2023] SGHC 360, which clarified the burden of proof in patent infringement cases involving process patents. On the legislative front, the Intellectual Property Office of Singapore introduced a pilot program waiving extension fees for search and examination requests, aiming to reduce costs for applicants and encourage timely filings. Singapore also reported a slight decline in overall patent filings in 2023 but emphasized its continued focus on sectors such as green technology and AI innovations.

The meeting underscored the diverse stages of patent law development among APAA member countries, from Myanmar’s nascent system to Singapore’s strategic refinements. These updates reflect the region’s commitment to fostering innovation and adapting to global trends. Through collaborative discussions and shared expertise, the APAA Convention continues to play a pivotal role in shaping Asia’s intellectual property landscape.
